Owner of Mitchell business that was raided last month pleads not guilty to DUI charges

The owner of a Mitchell business which was raided by several law enforcement agencies last month pleaded not guilty to DUI charges on Thursday. 44-year old Cory Cumings appeared in Davison County Court.

During the hearing, Assistant State’s Attorney Robert O’Keefe requested that bond for Cumings be modified or revoked, telling Judge Donna Bucher that Cumings is a danger to others and the community. O’Keefe noted that Cumings is accused of stalking an individual and making threatening phone calls. O’Keefe also noted that Cumings continues to break the law and has posted nearly $30,000 in bond money. He said that the risk of losing bond money is not a deterrent to Cumings.

Attorney Doug Dailey argued that Cumings is not a threat to others and that many of the charges against Cumings are trumped up due to custody and civil disputes. Dailey also noted that Cumings has been sober for 90 days.

Judge Bucher did not modify or revoke bond for Cumings but warned him to obey laws, or bond could be revoked in the future.

As a result of raids on his business, Mitchell Roofing & Siding, and his residence last month, Cumings has been charged with possession of a controlled substance, stalking, and permitting harassing or threatening phone calls.
