MITCHELL, SD (Mitchell Now) — Dakota Protein Solutions has filed a court challenge over restrictions tied to its operating permit in Turner County, arguing that conditions imposed by the county could effectively shut down the rendering facility.

The dispute centers on requirements added by the Turner County Board of Adjustment. The company contends the additional conditions make it difficult or impossible to continue operations at its plant near Freeman.

A judge has issued a temporary restraining order and a preliminary injunction, preventing Turner County from enforcing or revoking the permit conditions while the legal case proceeds. The ruling allows the Dakota Protein Solutions facility to remain open during the court process.

Court filings indicate the company is seeking relief from the contested restrictions, maintaining that the permit conditions exceed the county’s authority and threaten the viability of the operation.

Turner County officials have not commented publicly on the ongoing litigation.

The case will continue through the court system, with further hearings expected as both sides present arguments regarding the permit requirements and the county’s regulatory authority.
